When you or a loved one suffers from some form of injury, be it physical or even psychological, as the result of an accident, it is seen that personal injury has also occurred. Many personal injuries fall under tort which is one of the categories under this specific law. Tort can be intentional, negligent, nuisance, strict liability, etc.
Various injuries can happen under these civil wrongdoings in the sense that there are slip and fall accidents, auto accidents, medical injuries, defamation and even wrongful death. Under the intentional category, the act occurs because of a deliberate act by someone who commits tort (tortfeasor). A lawyer has to prove that the tortfeasor acted in a way that would result in injury for the injured party. This involves cases like assault, battery, trespass, etc. The most common tort in personal injury law is the negligent tort. When a reasonable person fails to do their duty or responsibility, it results in injury. Some examples of this are slip and fall accidents and medical malpractice.
Under the nuisance tort for personal injury law, this allows the injured party to sue for acts that interfere with their use and enjoyment of land. Strict liability encompasses a person is responsible for damages caused by their actions regardless of intent or fault. This is common in activities that are inherently dangerous like in cases where animals are involved. Personal injury can also occur when manufacturers produce defective goods. In cases like failing to include warning labels on a product entitles the injured party to sue.
