Legal Support / Freedom of Speech

One of the rights afforded to people in a society is the freedom of speech. This means that a person can speak about their ideas and thoughts without limitation or censorship. A synonymous term for this is the freedom of expression. This indicates speech or the imparting or receiving of information through different mediums.

Under Article 19 of the Universal Declaration of Human Rights, the right to freedom of speech is recognized. It is also recognized the International Covenant on Civil and Political Rights. This ensures that the right to hold opinions without interference is respected. Based on the freedom of speech law, there are limitations to freedom of speech. Legal systems as well as the society can limit this freedom when it conflicts with other values or rights. These limitations under the law follow a harm principle or an offense principle like those found in hate speech or pornography. It can either be limited through legal sanction or social disapprobation.

The freedom of speech law also involves the law of defamation where a person’s reputation is protected from unfair attack. This balances the private rights that people have with the public right to freedom of speech. It allows people to sue others who say or publish false or malicious comments. These may fall under slander or libel that injures a person’s reputation. When you’re charged with defamation, it can be a very complex and unpredictable situation. This is where you would definitely need the help and guidance of a person who has the skill and experience with the law.
